Getting Started

 

Gathering detailed information is the first stage of reviewing the scope of your risks and exposures. Generally, some of the following confidential information should be reviewed and discussed within the initial stages of the consulting process:

 

General Information:

 

The company's corporate mission statement

The company's risk retention and risk handling philosophy

An organizational chart and resumes of top management

A list of all subsidiaries, assumed names, joint ventures or partnerships

A description of any mergers, acquisitions, divestitures or discontinued operations

Review planned changes for the next three years regarding expansion, withdrawal etc.

A list and description of any third party management agreements

Copies of audited annual financial statements and management response letters

Copies of consent forms, hold harmless and indemnification agreements

A schedule of owned and leased fixed assets, contents and equipment for each location

Copies of real property and major equipment leases

Description of any sporting or social event sponsorships

A schedule of all law firms, accounting and other consulting firms engaged by the company
Copies of all marketing material, brochures, advertisements, articles and press releases

Copies of any guarantee, warranty, supply, service or sales agreements

A copy of your safety plan

A copy of your physical and electronic security policies

A copy of your disaster recovery plan

List of all business or professional operating licenses by state

Alternative risk handling review (self insurance, retention plans, contractual transfers etc.)

 

Insurance Information:

 

A summary of the company's insurance program for the past three years

Current projected annual payroll schedule and employee count by employee type

Annual payroll history and employee count by state

Current automobile schedule, garaging location and driver list

Insurance certificate schedule and requirements (and copies of  certificate samples)

Claims status report for all incurred, reserved and paid claims - insured and non-insured

Sales receipts summary by year

Copies of merger and acquisition agreements

Employee benefits and health plan summary

Copies of loss control surveys

Copies of experience modifier worksheets

Copies of the company's current insurance policies

Copies of risk collateralization agreements (if any)

Copies of insurance applications for fidelity, fiduciary liability, professional liability, 

    directors and officers liability and employment practices liability

 

Employment Information:

 

The company's personnel handbook and policy manual

A list and description of benefits for all employees

Copies of any employee leasing or labor interchange agreements

Copy of OSHA logs

Description of any medical facilities or professionals provided or contracted
Description of worker's compensation claim issues and concerns

Description of all employee problems including alleged wrongful termination,

    harassment, and/or discrimination complaints and EEOC complaints (if any)

 

Environmental Information:

 

Environmental site surveys, if any, for each property owned or leased by the company
A listing of hazardous substances used and copies of Material Safety Data Sheets (MSDS)
A description of the company's disposal methods
A list of environmental permits and licenses
Copies of all correspondence, notices and files related to EPA, state, or local regulatory

   agencies
Descriptions of any exposure to flammables, explosives, chemicals or demolition
A list identifying and describing any contingent environmental liabilities or continuing

    indemnification obligations

 

Litigation and Compliance:


A schedule and summary of any claims or threatened claims by, or against the company
A schedule and description of all pending litigation

A list identifying and describing any environmental litigation or investigations

Description of potential negligent acts, errors or omissions
A list of any unsatisfied judgments

List and description of any cease and desist orders, memorandums of understandings

Documents relating to any injunctions, consent decrees, or settlements
